The exclusive rights of the trademark holder will be granted or entitled when the trademark is officially registered with the General authority of Intellectual property and trademark certificate is issued.

Kazakhstan's accession to the World Trade Organisation, membership in the Eurasian Economic Union requires the improvement of national legislation in the area of intellectual property, elimination of contradictions and gaps, both within the provisions of national legislation and between national law and provisions of international agreements, to which Kazakhstan is a party.

According to the Amendment Law as of July 11, 2017, new paragraphs concerning advertisement have been added to the Law on Copyright and Related Rights. As per new paragraph 3rd of article 6, advertisement is the object of copyright within the terms of the Law on Copyright and Related Rights.

Moreover, according to another new paragraph (3-1) to article 32 of the Law on Copyright and Related Rights, advertisement maker, as well as producer of the advertisement are subjects of the related rights within the terms provided in the Law on Copyright and Related Rights.

Distinctive and unique designations in the form of word or combinations of figurative and verbal elements in any colours must be registered with the Agency for Intellectual Property of Uzbekistan to be recognised as trademarks and granted protection under Uzbek law.
